Regulations

I. General Provisions

  1. The online shop Vannabed.com is operated by Marta Janik acting under the name Marta Janik Realization, with registered office at ul. Studzienna 7/12, 53-304 Wrocław, NIP: 8992981323, REGON: 527384113.
  2. These Terms and Conditions set out the rules for the use of the Online Shop, placing orders for products available in the Online Shop, delivery of ordered products to the customer, payment of the selling price of the products by the customer, the customer's right to withdraw from the contract and the rules for making and dealing with complaints.

II. Definitions

  1. Customer - a natural person, a legal person or an organisational unit without legal personality, to which legal capacity is granted by law, using the Online Shop.
  2. Consumer - a customer who is a natural person, making a legal transaction with the Seller which is not directly related to his/her economic or professional activity.
  3. Product - a movable item available in the Online Shop, which is the subject of a Sales Agreement.
  4. Sales Contract - a contract of sale of a Product concluded between the Seller and the Customer via the Online Shop.
  5. Online Shop - the online service available at Vannabed.com through which the Customer can place orders.

III. Rules of using the Internet Shop

  1. The use of the Online Shop is possible on condition that the ICT system used by the Customer meets the minimum technical requirements.
  2. The customer is obliged to use the Internet Shop in a manner compliant with the law, the provisions of the Rules and Regulations and good practice.

IV. Methods and Deadlines of Payment for the Product

  1. The Seller shall make available to the Customer various methods of payment for the Sales Contract, in particular:
    a. Cash on delivery on delivery (in the case of finished rack designs).
    b. By bank transfer to the Seller's bank account.
    c. Electronic payments and payment card payments via authorised services (PayU).
  2. The current payment methods are set out in the Online Shop under "Payment methods" and each time on the sub-page of the respective Product.
  3. Personal collection of the Products at the Showroom is possible by Booking.
  4. In the event that the Seller does not receive payment from a Customer who has chosen to pay in advance, BOK may contact the Customer to remind him of the payment. Failure to make payment within 4 days of the Order being placed and thereafter within an additional 3-day period will result in non-acceptance of the offer made by the Customer.
  5. If the Customer chooses to pay cash on delivery, the Customer is obliged to make payment on delivery. The Customer's refusal to collect the Product despite setting an additional deadline is a condition that terminates the Sales Contract.

V. Cost, Methods and Delivery Dates of the Product

  1. Delivery of the Product is available in the territory of the Republic of Poland and selected countries of the European Union (Slovakia, Czech Republic, Germany, Austria).
  2. The delivery of the Product to the Customer is chargeable. The Product delivery costs are indicated in the "Offer" tab in the Online Shop and each time on the subpage of the given Product.
  3. The Seller shall make the following methods of delivery of the Product available to the Customer:
    a. Courier delivery.
    b. Cash on delivery courier service.
  4. The deadline for delivery of the Product to the Customer is up to 14 working days, unless a different deadline is specified in the description of the Product in question or when placing the Order.
  5. The time taken by the Seller to prepare an Order for dispatch is each time presented on the sub-page of the Product in question and is calculated from the date:
    a. Crediting of the Seller's bank account or settlement account - if the Customer chooses to pay by bank transfer, electronic payment or payment card.
    b. Conclusion of the Sales Agreement - in case the Customer chooses the cash on delivery payment method.

VI. Withdrawal policy

  1. The consumer has the right to withdraw from the contract without giving any reason within 14 days of receiving the Product.
  2. In order to exercise the right of withdrawal, the Consumer must inform the Seller of his or her decision to withdraw from the contract by an unequivocal statement which may be made:

    b. In writing to the following address: Marta Janik Realization, 7/12 Studzienna Street, 53-304 Wrocław
  3. In the event of withdrawal, the Consumer shall be refunded all payments, including the costs of delivery of the Product (except for the additional costs arising from the method of delivery chosen by the Consumer other than the cheapest usual method of delivery offered by the Seller), immediately and in any event not later than 14 days from the day on which the Seller was informed of the Consumer's decision to exercise the right of withdrawal.
  4. Refunds will be made using the same means of payment as those used by the Consumer in the original transaction, unless the Consumer has expressly agreed otherwise; in any event, the Consumer shall not incur any fees in connection with such refunds.
  5. The Seller may withhold reimbursement until it has received the Product back or until it has provided the Seller with proof of return, whichever event occurs first.
  6. The Consumer is obliged to send back the Product immediately, and in any case not later than 14 days from the day on which he or she informed the Seller about the withdrawal from the contract. The deadline is met if the Consumer sends back the Product before the expiry of the 14-day period.
  7. The consumer shall bear the direct costs of returning the Product.
  8. The consumer shall only be liable for any diminution in the value of the Product resulting from the use of the Product other than what was necessary to establish the nature, characteristics and functioning of the Product.

VII. Product complaints

  1. The basis and scope of the Seller's liability towards the Customer if the sold Product has a physical or legal defect (warranty) are specified in the provisions of the Civil Code Act.
  2. Products presented in the Online Shop may be covered by a manufacturer's or distributor's warranty. Detailed warranty terms and conditions and its duration are given in the warranty card attached to the Product.
  3. The Seller is obliged to supply the Customer with a defect-free Product.
  4. A complaint may be lodged by the customer by e-mail to the following address martajanik12@gmail.com. In the event of a complaint about a Product, it is advisable to deliver it to the Seller so that the Product can be examined.
  5. If the sold Product has a defect, the Customer may:
    a. Make a declaration to reduce the price or withdraw from the Sales Agreement, unless the Seller immediately replaces the defective Product with a defect-free one or removes the defect.
    b. Demand that the Product be replaced with a defect-free Product or that the defect be rectified.
  6. The Customer may, instead of having the defect remedied, demand that the Product be replaced with a defect-free one or, instead of replacing the Product, demand that the defect be remedied, unless the method chosen by the Consumer is impossible or requires excessive costs.
  7. It is recommended that the Customer provide the following information in the description of the complaint: information on the subject of the complaint, type and date of occurrence of the defect, request for the method of bringing the Product into conformity with the Sales Agreement or declaration of price reduction or withdrawal from the Sales Agreement, as well as contact details of the complainant.
  8. The Seller shall respond to the Customer's complaint immediately, no later than within 14 days of its receipt. If the Customer has requested replacement of the item or removal of the defect or has made a declaration of price reduction and the Seller has not responded to this request within 14 days, it shall be deemed that the Customer has acknowledged the request as justified.
  9. The Seller shall be liable under the warranty if a physical defect is found before the lapse of two years from the date of delivery of the Product to the Customer. A claim for rectification of a defect or replacement of the Product shall become time-barred after one year from the date on which the defect was found, however, in the case of an Order placed by a Consumer - the period of limitation shall not end before the lapse of the period referred to in the first sentence.

VIII. Final Provisions

  1. The Terms and Conditions shall enter into force on the date of publication on the website of the Online Shop.
  2. The Seller reserves the right to amend the Terms and Conditions. Any changes shall come into force on the date indicated by the Seller, no shorter than 14 days from their publication on the website of the Online Store. Orders placed before the date of entry into force of the amendments are fulfilled on the basis of the provisions in force on the date of placing the Order.
  3. In matters not covered by these Terms and Conditions, the provisions of Polish law, in particular the Civil Code and the Act on Consumer Rights, shall apply.
  4. Any disputes arising between the Seller and the Customer shall be settled by the competent court in accordance with the provisions of the Code of Civil Procedure.
